Booking fee & Charge

All bookings come with a Booking Fee to secure the Performer(s) and cover all administrative costs. The Booking Fee is
non-refundable. The Remaining Balance is payable 30 days before your Date of Event.

Cancellation by the Client

a. when the Booking is cancelled less than 12 months prior to the Date of Event then 50% of the Remaining Balance will be
due.
b. when the Booking is cancelled less than 6 months prior to the Date of Event, then 75% of the Remaining Balance will be
due.
c. when the Booking is cancelled less than 2 months prior to the Date of Event, then 100% of the Remaining Balance will be
due.
d. When the booking is cancelled more than 12 months prior to the Date of Event, then no remaining payment(s) will be due
but all payments including the booking fee currently made to Shades of Sax Ltd are forfeited

Cancellation by Shades of Sax

a. Shades of Sax withholds the right to choose and change the Performer(s). If the Performer(s) is unable to make the Event due
to exceptional circumstances – such as illness, a personal/family circumstance, family emergency, travel issues or any other
reason – the Client will be informed as soon as is reasonably practical, and a replacement act or refund of the Performer(s) will
be offered.
b. In the event that the Booking is cancelled by Shades of Sax, all payments made by the Client will be refunded in full, including
the Booking Fee

Performer Responsibilities

a. Our booked Performer(s) hereby agrees to perform entertainment services for Client at the Event specified above in a
professional manner according to the prevailing standards in the industry (“Services”).
b. The performer(s) may employ one or more assistants.
c. Performer(s) are not responsible for the impact on the final product of any interference caused by guests or other vendors at
the Event. The performer(s) will make every effort to obtain, but cannot guarantee delivery of, any specific entertainment
requested by Client because of the performer’s lack of control over the Event, its participants, weather, and any rules or
restrictions of the venue or official conducting the Event.
d. If the performer(s) are exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the Event, the performer(s)
reserve the right to take reasonable action to remedy such a situation, including, but not limited to leaving the Event. In such
event, the Performer(s) will not be obligated to refund any of the fees paid by Client because of such action

Force Majeure

If the Performer(s) is unable to attend Event due to fire, flood, casualty, strike, civil disturbance, war, terrorism, sickness or other
acts of God beyond the parties’ control, then the Performer(s) shall return all money paid by Client (minus the Booking Fee), and
this Agreement shall immediately terminate

Promotion

The Client hereby give permission for Shades of Sax and its booked Performer(s) to use my/our name(s) and photographic
likeness in all forms and media for advertising, trade, promotional and any other lawful purposes such as promotion and
marketing

Data Protection

a. The Client agrees that Shades of Sax will handle all payments, contracts and Client details. The booked Performer(s) will be
given access to all Client details.
b. The Client hereby consents to the collection, use and retention of the Clients personal data by Shades of Sax for the sole
purpose of execution of this Contract, which includes enabling the Performer(s) to perform the Event and for the purpose of
Promotion, as set out above.
